Kaldı ki bir fiil için tek cezaya mahkum edilmesi birden fazla cezaya hükmedilmemesi ilkesi de bunu gerektirir. Eğer ki soruşturma zamanaşımı geçtiyse ilgili fiil nedeniyle hakkınızda herhangi bir idari para cezası tatbik edilemez. Ancak elbette burada zamanaşımının hesaplanması yapılırken son işlenilen fiil veya eğer ki kabahat müteselsil tek bir fiil ile işlenebilen kabahat ise kabahatin işlendiği son gün baz alınacaktır. Yani mesela “gece vakti alkol satışı yapmak” gibi fiilden dolayı idari para cezası tatbik edilmesi gündemdeyse bu halde her bir alım-satım fiili ayrı ayrı idari para cezasına ve bağımsız zamanaşımı sürelerine tabi olacaktır. Ancak mesela “afiş asma” gibi bir kabahati aynı içerikteki afişlerin asılması şeklinde aylara bölünerek yapılması halinde tek bir kabahatin oluştuğu varsayılacak ve zamanaşımı da son afişin asıldığı günden itibaren başlayacaktır. Ama elektronik paralarla kumar oynayarak kaybedenlerin içine düştükleri pişmanlık, onları bir günah keçisi arayışına itti. Sonuçta da Ukash adı verilen elektronik para satıcılarıyla kumar alışkanlığı olan vatandaşlar karşı karşıya geldi. Satıcılar hukuki ve cezai sorumluluktan kurtulmak için sattıkları elektronik paranın yasal amaçlarla kullanılıp kullanılmadığı konusunda “müşterinin” sorumlu olduğu konusunda uyarı (!) yapmaya başladılar.

Sahip olunan kodlar, satıcılardan ve Ukash kabul eden internet sitelerinden bozdurulabilir. Dolayısıyla piyasadaki başıboşluk elektronik para sahiplerinin çeşitli şekillerde dolandırılmasına zemin hazırladı. Türkiye’de ek bir uzantıyla yasa dışı bahis ve kumar oynatılan siteler genellikle yurtdışından yönetiliyor. Bu işletmelerin sattığı ön ödemeli sanal kartların günlük hayattaki alış verişler için üretilmediği aşikârdır. Satıcılar her ne kadar aksini iddia etseler de elektronik paraların kumar oynanmasına finansal açıdan aracılık etmekten başka, günlük hayatta kullanımının olmadığı hepimizin malumu. Verilen idari para cezasının yanında kaçak iddaadan elde ettiği gelire de devlet tarafından el konulur. Bahis sebebiyle idari para cezası memuriyete engel mi hususunda 7258 sayılı Kanun ve 657 sayılı Devlet Memurları Kanunu bu konuda açık bir hüküm içermez. Bahis cezasından bir mahkumiyet bu maddeye girerse, 657 sayılı Kanun m. Dolayısıyla kanuna aykırı olarak şans ve bahis oyunları oynatma fiili karşılığında öngörülen adli para cezaları adli sicile işler. Ancak kanuna aykırı olarak oynatılan şans ve bahis oyunlarını oynama fiili için öngörülen idari para cezaları adli sicile işlemez. Bu tür illegal kumar ve bahis siteleri başlangıçta mağdurlara kısmi kazançlar sağlayıp güven kazanmaktadır.

Kaçak kumar veya kaçak bahis sitesinden kazandığınız para size ödenmezse hukuki açıdan hiçbir şey yapamazsınız. Zira Borçlar Kanunu madde 604 açık şekilde bir hüküm içermektedir. “Kumar ve bahisten doğan alacak hakkında dava açılamaz ve takip yapılamaz.” demektedir. Zaten bunu bilen ve kumar ve bahis  dolandırıcılığı yapan kişiler kazanılan paraları çoğu zaman ödememektedir. Hatta bazı kumar sitelerinde oyuncuların hesaplarında bulunan paraların buharlaştırıldığını bilmekteyiz. Veya oynamadıkları oyunları oynadıkları iddiasıyla parayı kaybettikleri söylenerek kişiler dolandırılmaktadır. Dolayısıyla bu sitelerde kaybettiğinizde paranızın azalmakta ancak kazandığınızda paranızın artmamaktadır. Bu tür kaçak kumar ve kaçak bahis sitelerinde kesinlikle oyun oynanmasını tavsiye etmiyoruz.

Yasadışı bahis operasyonu genellikle gizlilik kararı verilen soruşturmalardandır. Yasa dışı bahise ilişkin savcılık ve dava aşamasında savunma yapmak ve itiraz etmek önemlidir. Diğer yazılarımızda da açıkladığımız üzere dolandırılan paranın geri alınması ancak faillerin yakalanması ile ve bu da ancak yasal süreçle mümkün olabilmektedir. Eğer etkin bir soruşturma süreciyle dolandırıcılar yakalanırsa dolandırdıkları paraları iade etme eğiliminde olacaklardır. Zira dolandırıcılık suçlarında etkin pişmanlıktan yararlanmaları durumunda alacakları ceza büyük oranda azalacaktır. Bahisçileri güncel olaylar hakkında bilgilendirmek ve onlara katılma fırsatı vermek için halka açık bahisler de sunabilirsiniz. Örneğin, sporla alakalı olmayan popüler bir bahse katılabilirler.

Sonuç olarak idari para cezalarının ve yaptırımların iptali sıkı takip ve çalışma gerektiren, bilgili ve ehil bir hukukçu kanalıyla yürütülmesi gereken bir süreçtir. İdari yaptırımlara karşı iptal davası açmadan önce sürelere ve zamanaşımlarına dikkat etmelisiniz zira İYUK’a göre (İdari yargılama usul kanunu) 60 günlük dava açma süreniz vardır. Tam yargı davası için zararın öğrenildiği tarihten itibaren 1 yıl içerisinde (her halde 5 yıl içerisinde) ilgili idareye başvuru yapılması gerekmektedir. 60 gün içerisinde bu itiraza bir cevap gelmez ise cevabınız reddedilmiş sayılır ve 2 aylık dava açma süreniz işlemeye başlar (dikkat edin zamanaşımı ve dava açma süresi aynı şey değildir) . Bu kısım biraz karışık, tam olarak anlamadınız biliyorum size anlayabilmeniz için bir grafik çizeceğim. Ülkemizdeki geliştiricilere de konu ile ilgili bir e-posta ileten Google Play Store, kumar uygulamalarına artık Türkiye’de izin verileceğini duyurdu.

[312] Madde 30 – Şikayetler ve itirazlar mutlaka tahkik olunarak bir karara bağlanır ve neticesi şikayet edene ve lüzum görülürse şikayet olunana mümkün olan en kısa zamanda bildirilir. Adli tahkikata mevzu olan şikayet ve itirazlar hakkında Ceza ve Usul kanunlarındaki hükümler mahfuzdur. Taksirli suçlardan verilen cezalar hariç olmak üzere, askeri mahkemelerce üç aydan fazla hapis cezası ile birlikte Türk Silahlı Kuvvetlerinden çıkarma cezası da verilebilir. [95]  “Bir fiil toplu erbaş ve er karşısında yapılmış sayılarak kanunun bu kayıt ile takyit ettiği hükümlerin tatbiki için amir veya mafevk ile failden veya şeriklerden başka askeri hizmet maksadıyla toplanmış en az yedi askeri şahsın bulunması şarttır” (AsCK. m.14). [38]   AsCK’da halen ölüm cezası içeren hükümler bulunmakla birlikte, ölüm cezası, 2004 tarihli 5170 SK’la Anayasa’nın 38. Maddesinde yapılan değişiklik sonucu tamamen kaldırıldığından uygulama kabiliyeti kalmamıştır.

• Örneğin Mahkemenin kalem personelini bir günde tayin edip mahkemeyi işlemez hale getirebilir.
• Disiplin cezalarında amaç unsuru yönünden sakatlık hali, ancak disiplin amirinin haksız yere kasten ceza vermesi halinde gerçekleşebilir.
• Ödeneğin aylık tutarı en yüksek Devlet memurunun almakta olduğu miktarı, yolluk da ödenek miktarının yarısını aşamaz.

(4) Yukarıdaki fıkralarda yazılı bildirimler, varsa müdafie yapılır.Müdafii sanığa tanınan haklardan onun gibi yararlanır. (2) Mahkeme, fiilinnitelendirilmesinde iddia ve savunmalarla bağlı değildir. (2) Cumhuriyet savcısı, katılan veya vekili, sanığın, müdafiinin veyakanunî temsilcisinin açıklamalarına; sanık ve müdafii ya da kanunî temsilciside Cumhuriyet savcısının ve katılanın veya vekilinin açıklamalarına cevapverebilir. Bu kişilerin dinlenmesi yerine, daha önce yapılan dinleme sırasındadüzenlenmiş tutanaklar ile kendilerinin yazmış olduğu belgeler okunabilir. (3) Cumhuriyet savcısı ile sanık veya müdafii birlikte rızagösterirlerse, tanığın dinlenmesinden veya başka herhangi bir delilin ortayakonulmasından vazgeçilebilir. (2) Ancak, sanık kendi istemi üzerine duruşmadan bağışık tutulmuş veyamüdafii aracılığıyla temsil edilmek yetkisini kullanmış olursa artık eski hâlegetirme isteminde bulunamaz. (4) Yukarıdaki fıkralar içeriğine göre sanığın aynı anda görüntülü vesesli iletişim tekniğinin kullanılması suretiyle sorgusunun yapılabilmesiolanağının varlığı hâlinde bu yöntem uygulanarak sorgu yapılır. (2) Sanık savuşur veya ara vermeyi izleyen oturuma gelmezse, öncedensorguya çekilmiş ve artık hazır bulunmasına mahkemece gerek görülmezse, davayokluğunda bitirilebilir. (2) Sulh ceza mahkemelerinde yapılan duruşmalarda Cumhuriyet savcısıbulunmaz. (3) Sanığın kabul edilen istemleri, Cumhuriyet savcısına da bildirilir. (2) Bu dilekçe üzerine verilecek karar, kendisine derhâl bildirilir.
